Terms of Service

1. 1. Use of the site and portal

   We grant you a limited, non-exclusive, non-transferable and revocable licence to use the public pages of this site for informational and professional purposes.

   The portal is not public. Access is limited to employees, contractors and clients holding an account created by a Tricana Group administrator, and is subject to the permissions attached to that account. We may suspend or remove an account at any time.

2. 2. Accounts and security

   If you hold a portal account, you are responsible for keeping your credentials confidential and for activity carried out under your login. Do not share your password or let another person use your account.

   Tell us immediately if you believe your credentials have been exposed or your account has been used without your permission.

3. 3. Enquiries, appointments and consent to be contacted

   When you submit the contact form you give us your name, email address, phone number and whatever you write in the message field. You are asking us to reply, so by submitting it you agree that we may contact you about your enquiry and about our services, including by email, phone call and text message, at the details you provided.

   That contact may include scheduling and confirming appointments, consultations and site visits; sending estimates, proposals and project updates; and marketing or outreach about our work and services. Consent to marketing contact is not a condition of doing business with us, and you can withdraw it at any time. See the Privacy Policy for how to opt out and for what we do with the information.

   Message and data rates may apply to text messages. Automated messages, where we use them, are limited to appointment reminders and confirmations.

   Please do not send confidential, sensitive or privileged information through the contact form. It is a general enquiry channel, not a secure one.

4. 4. Estimates, proposals and no offer of contract

   Nothing on this site is a bid, quote, estimate or offer to perform work, and nothing on it creates a contract. Project descriptions, photography, timelines, specifications and pricing discussion are illustrative of past or typical work.

   Any work we perform is governed solely by a separate written agreement signed by both parties. Where these Terms and a signed project agreement conflict, the signed agreement controls for that project.

5. 5. Intellectual property

   Some stock photography on the Service is used under the Pexels licence (pexels.com/license). Everything else, including our custom photography, project imagery, drawings and overlays, written copy, design system, code, logo and trade marks, is the property of Tricana Group or its licensors.

   You may not copy, reproduce, modify, republish, distribute or create derivative works from any part of the Service without our prior written consent. You may share links to public pages.

6. 6. Acceptable use

   You agree not to:

   • use the Service unlawfully, or to harass, defraud or impersonate anyone
   • submit false contact details, or another person's details without their permission
   • attempt to access an account, dataset or part of the portal you have not been granted
   • probe, scan, overload or interfere with the Service or its infrastructure
   • scrape, harvest or bulk-collect content or contact information from the Service
   • upload malicious code or anything designed to disrupt the Service

7. 7. Third-party links and services

   The Service links to sites and tools we do not control. We are not responsible for their content, availability or privacy practices, and a link is not an endorsement. Their terms govern your use of them.

8. 8. Disclaimer of warranties

   The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

   We do not warrant that the Service will be uninterrupted, secure or error-free, or that the content is complete, current or accurate. Construction information on this site is general and is not engineering, architectural, legal or financial advice for your project.

9. 9. Limitation of liability

   To the fullest extent permitted by law, Tricana Group and its owners, directors, officers, employees and agents are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of your use of or inability to use the Service.

   Our total liability arising out of the Service is limited to one hundred United States dollars (USD 100). This section limits liability for the Service, not for work performed under a signed project agreement, which has its own terms.

10. 10. Indemnification

    You agree to indemnify and hold Tricana Group harmless from claims, losses, liabilities and reasonable legal fees arising out of your misuse of the Service, your breach of these Terms or your violation of the rights of a third party.

11. 11. Changes to these Terms

    We may update these Terms. The revised version is posted on this page with a new date at the top, and it takes effect when posted. Continuing to use the Service after that means you accept the change.

12. 12. Governing law

    These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. The state and federal courts serving Orange County, California have exclusive jurisdiction, and you consent to venue there.

    If a provision of these Terms is held unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it.
